APPLE FILES PATENT FOR KINECT LIKE MOTION CONTROL DEVICE


With the success of Microsoft’s Kinect device on both Windows PCs and the 360, you knew it was only a matter of time before the folks at Cupertino would try to cash in on motion control. Pictured above is an image taken from a patent application submitted by Apple that outlines a “three-dimensional imaging and display system.”

The concept illustrated here is pretty simple, the square device laying in front of the user on the table is the motion sensor that detects gestures and movements for user interactions. Using an infrared laser, the unit makes an imaginary “box” represented by the dotted lines that a user puts their hands inside to manipulate their desktop.

MICROSOFT SUED FOR PATENT INFRINGEMENT IN KINECT CONTROLLER


Microsoft is being sued for patent infringement over motion-sensing technology used in its blockbuster gaming accessory, the Microsoft Kinect. Ohio-based Impulse Technology has filed a complaint alleging that Microsoft’s Kinect controller infringes on seven of its technology patents. One patent referenced in the lawsuit covers “wide variety of games where the movement of a player is tracked in three dimensions…and certain exercise games where the motion of the player is tracked to effect movement of a virtual avatar, and the exertion of the user is monitored, including where the tracking of the player is done by the use of a camera.” A separate patent describes an “education system challenging a subject’s physiologic and kinesthetic systems to synergistically enhance cognitive function.”

Impulse Technology is seeking a permanent injunction to block the import and sale of Microsoft’s Kinect, and it is also suing Electronic Arts, Konami and Sega for developing Xbox 360 games that utilize Kinect and infringe on its patents. Impulse is seeking damages, treble damages, interest, and attorney fees from Microsoft as well. The Kinect motion-based video game controller has been a smash hit for Microsoft, having set numerous sales records since its launch. This past March, Microsoft announced that it had sold 10 million Kinect controllers since the device’s launch just before the holidays last year.

KINECT HACK ALLOWS WEB BROWSER AND WINDOWS 7 CONTROL BY GESTURES

The hacks for Microsoft's Xbox 360 Kinect just keep getting better. MIT's Media Lab Fluid Interfaces Group has hacked the Kinect to allow users to control web browsers and Windows 7 using only gestures.

The MIT group used DepthJS, a system that makes Javascript talk to Microsoft's Kinect in order to navigate web pages, among other things. It's not that making wild, arm-waving gestures is the best way to navigate a web site, it's just a demonstration that you can and advances the technology. Hopefully the group, or other hackers, can take this advance and evolving it into a multitouch remote control plugin for our home theater PCs. [Engadget]

MICROSOFT EXEC CAUGHT IN PRIVACY FLAP AROUND KINECT

Microsoft's Dennis Durkin voiced an interesting idea at an investment summit last week -- the idea that the company's Kinect camera might pass data to advertisers about the way you look, play and speak. "We can cater what content gets presented to you based on who you are," he told investors, suggesting that the Kinect offered business opportunities that weren't possible "in a controller-based world."

And over time that will help us be more targeted about what content choices we present, what advertising we present, how we get better feedback. And data about how many people are in a room when an advertisement is shown, how many people are in a room when a game is being played, how are those people engaged with the game? How are they engaged with a sporting event? Are they standing up? Are they excited? Are they wearing Seahawks jerseys?


Needless to say, sharing this level of photographic detail with advertisers presents some major privacy concerns -- though it's nothing we haven't heard before -- but moreover it's explicitly against the privacy policy Microsoft presents Kinect users. "Third party partners use aggregated data to deliver Kinect experiences (games or applications), to understand how customers use their Kinect experiences, and to improve performance or even to help plan new experiences," the Kinect Privacy and Online Safety FAQ reads, but also "They are not permitted to use the information for marketing purposes such as selling you games or services, or for personalizing advertising" (bolding ours).

In an email to the Wall Street Journal, Microsoft flatly denied that the Kinect would do anything of the sort, whether via third-party partners or otherwise. "Xbox 360 and Xbox LIVE do not use any information captured by Kinect for advertising targeting purposes," representatives wrote. Honestly, some of us at Engadget still think targeted advertising is kind of neat, but we know how seriously you take this stuff. [Engadget]

MICROSOFT KINECT OFFICIALLY LAUNCHES

One of the hottest gaming accessories for the holiday season has officially launched today. The Kinect from Microsoft is a hands-free game controller that connects to the Xbox 360. The device allows users to use body gestures to interact with video games. Microsoft expects to sell 3 - 5 million units during the busy holiday shopping season, an increase from earlier estimates. If you plan on getting one this year, you might want to consider buying early as there may be a shortage as the holidays approach. [BGR]

NINTENDO LOSES MONEY FOR FIRST TIME IN SEVEN YEARS

Due to poor sales of its flagship products, the DS and the Wii, Nintendo has post a loss for the first half of the year.  This is the first loss in over seven years for Nintendo.  The DS slid from 11.7 million units last year to 6.69 million this year.  This is to be expected since the DS has been around for almost six years and the 3DS will be launching soon.

What is unexpected is that Wii sales have fallen off as well.  Last year 5.75 million Wii's were sold compared to 4.97 million this year.  This could be explained by the increased interest of the Microsoft Kinect and Sony Move for the Xbox 360 and Playstation 3 respectively.

Also contributing to the loss is the big slip in the value of the Yen.  Combining all these factors mean Nintendo's net income was down 33.7% over the same time last year and operating income was down 48% for the same period. [Gizmodo] [Kotaku]

SONY MOVE ON SALE EARLY

The Sony Move for the Playstation3 is not suppose to be on sale until September 19th, but an Engadget reader has managed to snag one at a Benton Harbor, MI Best Buy.  If you are wanting to buy one, you might be able to find it available at your local Best Buy.
