GAME CONSOLE OWNERS STREAMING MEDIA USAGE INCREASES SIGNIFICANTLY

New data from Nielsen suggests that console owners are using their Xbox 360, PS3 and Wii game consoles to stream video content more than ever before. “Streaming now represents a reported 14 percent of Xbox 360 time, 15 percent of PS3 time and 33 percent of Wii time,” Nielsen said Wednesday. The market research firm explained that the growth in time spent streaming was driven by services such as ESPN 3, Netflix, MLB Network and Hulu, but that time spent using consoles also increased overall. Console usage during the first half of 2011 jumped 7% from the same time period last year. Nielsen said gaming is the most popular activity on Xbox 360 (34% of usage), the PS3 is most used for DVD/Blu-ray viewing (22% of usage) and the Wii is used most for offline gaming (55% of usage)

RUMOR: SILVERLIGHT 5 MAY BE LAST AND ONLY WORK ON INTERNET EXPLORER

Could Microsoft's Silverlight soon be following in the footsteps of Adobe's Flash Player for mobile devices? That's still unconfirmed by Microsoft, but ZDNet's Mary-Jo Foley is reporting that she's heard from several sources who say that Silverlight 5 will be the last version of the rich media platform, and that it's not clear how long it will be supported after it's released later this month. What's more, another source tells Foley that the final version of Silverlight 5 itself might only work with Internet Explorer on Windows, as opposed to earlier versions that have also supported Chrome and Safari on both OS X and Windows. As ZDNet notes, however, the end of Silverlight wouldn't necessarily mean an end to all of the work Microsoft has done on Silverlight -- we've already heard about a Silverlight-like app framework that's coming in a future Xbox update, and many of the same principles can also be found in the Metro-style apps for Windows 8.

HUGE UPDATE COMING FOR XBOX'S MY XBOX

In the coming days, the familiar “My Xbox” section of Xbox.com is going away. Fear not: It’s being replaced with a significant update that will make it even easier to see what your friends are doing on Xbox LIVE. My Xbox is being superceded by the new “Social” section, which not only lets you see at a glance what your friends are up to, but also gives you early access to one of the coolest features coming in the next Xbox 360 dashboard update. That’s right: Xbox.com users will be the very first to try the new Beacons feature, which lets you mark games you want to play with others, making it easier to find friends who want to play the same games.

Other site enhancements are on the way, including the ability to search the Zune video catalog and buy/rent movies and TV shows right from your browser.

MICROSOFT GETS ANTI-TRUST APPROVAL TO SWALLOW SKYPE

Microsoft just crossed another hurdle in its bid to swallow Skype whole. Earlier today, US antitrust approval was given on Microsoft's largest (proposed) acquisition, clearing the path for all sorts of Windows / Xbox / WP7-related VoIP shenanigans. While many are still questioning the logic here, Skype continually brought around 145 million users to the table per month even while it constantly bled money. Whatever the case, it looks as if the accountants in Redmond just got FTC permission to move $8.5b from one column to the next, and with an initial investment like that, we're hoping for a number of updated features as the attack plan unfolds.

RUMOR: EA HAS NEXT XBOX HARDWARE; MICROSOFT REVEALING IT AT E3

When Nintendo confirmed E3 would be the event where the Wii 2 is being unveiled, we thought it was a clever move that would see the company have a clear run for a couple of years. Added to that the rumor it is a very powerful machine and it could leave the PS3 and Xbox 360 in the dust. But that may no longer be the case, and Microsoft could be about to cause a major upset come this June.

Develop has been told that EA is already in possession of the successor to the Xbox 360 and is doing some early development tests with it. As with all early hardware builds, the next Xbox currently takes the form of a PC desktop case, but what’s inside is the hardware that will be inside Microsoft’s next console.

The same source also believes that Microsoft is aiming for an end of 2012 launch date, which would put it in direct competition with the Wii 2. Worse news for Nintendo comes in the form of a potential surprise reveal during E3 next month.

For gamers this is great news. Two new consoles being revealed at E3 will certainly generate some excitement, especially if one clearly out performs, or out innovates, the other. Whether Microsoft planned this all along and Nintendo suprised them with a Wii 2 announcement, or the Xbox Next plans have been rethought due to the Wii 2 we don’t know. We are just really looking forward to E3 now.

As is usually the case, Microsoft and EA are saying nothing.

VIDEO GAME HARDWARE AND SOFTWARE SALES DECLINING

There was a time when you couldn't go three years without having to shell out $300 for the latest and greatest videogame console, something with mind-blowing graphics and slight refreshes of the games you'd already bought twice before. Those days are past, with the Xbox 360 over five years old and the PlayStation 3 four, yet neither having any replacements in the wings. Perhaps this is partly why videogame hardware sales are declining, down eight percent in January compared to this time last year according to NPD. Software sales are meanwhile down five percent

WINDOWS PHONE 7 TO GET IE9, MULTI-TASKING AND XBOX INTEGRATION

Microsoft is planning to introduce multi-tasking and full integration with Internet Explorer 9 in future updates to its Windows Phone 7 mobile operating system later this year. IE9 on Windows Phone 7 will use the same core browsing engine as on PCs. Microsoft also talked about the importance of multi-tasking, and claims it can now offer fast task switching without causing serious detriment to the battery life. In particular, Microsoft said, this will improve the experience of using third party applications. In a demo, a Microsoft engineer showed how a music application called 'Slacker' could keep music playing in the background while the user moved between different applications. By holding down the 'back' button, users can also see all their recently accessed applications, allowing them to switch easily between them.

PROSECUTORS DROP XBOX-MODDING CHARGES MID CASE

Federal authorities in the first-of-its-kind game-console–modding criminal trial abruptly dropped their prosecution here Thursday, "based on fairness and justice." What happened?

"The government has decided to dismiss the indictment," prosecutor Allen Chiu told the judge shortly before the jury was to be seated on the third day of trial.

The announcement came a day after a whirlwind of legal jockeying in the case against defendant Matthew Crippen, a 28-year-old Southern California man. The government charged that Crippen, a hotel car-parking manager, ran a small business from his Anaheim home modifying the firmware on Xbox 360 optical drives to make them capable of running pirated or unauthorized games.

It was the nation's first jury trial to test the anti-circumvention provisions of the 1998 Digital Millennium Copyright Act as applied to game consoles. The law makes it a crime to offer a product or service that circumvents a technological measure designed to protect copyright material. Each of the two charges carried a maximum five years.

"It still has not hit me yet," Crippen said outside court, moments after Chiu dismissed the indictment.

U.S. District Judge Philip Gutierrez had blasted the prosecution's case Wednesday, prompting a brief recess for prosecutors to decide whether they would forge ahead. The prosecution's decision to continue would come back to haunt them as the government's first witness ultimately unraveled their case.

Witness No. 1, Tony Rosario, was an undercover agent with the Entertainment Software Association. He told jurors Wednesday that he paid Crippen $60 in 2008 to modify an Xbox, and secretly videotaped the operation. Rosario had responded to Crippen's advertisement on the internet and met Crippen at his Anaheim house.

All of that had been laid out in pretrial motions. But during his testimony, Rosario also said Crippen inserted a pirated video game into the console to verify that the hack worked. That was a new detail that helped the government meet an obligation imposed by the judge that very morning, when Gutierrez ruled that the government had to prove Crippen knew he was breaking the law by modding Xboxes.

But nowhere in Rosario's reports or sworn declarations was it mentioned that Crippen put a pirated game into the console. During the opening statements shortly before Rosario's testimony, defense attorney Koren Bell told jurors that there would be no evidence of that kind.

Defense attorney Callie Steele objected to the new testimony. And as court was to get underway here early Thursday, prosecutor Chiu told the judge that he first learned of Rosario's newfound recollection days before trial. Chiu conceded he never forwarded that information to the defense. [Gizmodo]

40% OF XBOX LIVE SUBSCRIBERS USE DEVICE AS A SET-TOP BOX THAN A CONSOLE

These days, you no longer are limited to playing games on the 360, but can also watch Netflix, listen to music through Zune, check your Facebook or Twitter accounts, or even watch a game on ESPN.

The Xbox 360 has almost become a set-top box, and speaking to attendees of BMO Capital Markets’ Digital Entertainment Conference in New York yesterday, Microsoft’s Dennis Durking confirmed that there’s actually a lot of people who never even play a game on their 360s.

According to Durkin, 40 percent of all members of Xbox Live are spending their time on the console not gaming, but using other features… and these guys aren’t just dabbling. On average, in fact, they are spending three hours online a day, but not playing any games. They’re using it like a computer.

“What we found is the core gamer might be the person who brought the console into the house, but as you widen the choices of content, it broadens what people can do with the system,” said Durkin.

It makes sense: the Xbox 360 is actually excellent at doing most of the things a set-top box can do. If you have any interest in gaming whatsoever, why buy an AppleTV or Boxee Box when you already have something hooked up to your television which can do most of the same things. [Geek]

HALO REACH REQUIRES HARD DRIVE TO PLAY CO-OP

One of the driving factors in the success of the Halo franchise is the addicting multi-player and co-op modes.  Halo Reach, the newest in the franchise, is requiring the player to have the optional hard drive for the 4GB Xbox 360 in order to play the co-op mode.  This "bug" affects only the 4GB version of the popular gaming console and has been reported to affect both the local play as well as that across Xbox Live.

Microsoft is aware of this issue and is "quickly working to resolve it."  Standard multi-player mode is unaffected by this issue. [Engadget]

LEAKED: AT&T U-VERSE ON XBOX

A snapshot has been leaked showing Xbox prompts in AT&T's U-Verse technical support screen.  It is no surprise that Microsoft has been trying to integrate more media into the Xbox as it was announced recently that U-Verse customers would soon have access to Mediaroom functionality.

The Xbox integration is supposedly being field tested using AT&T employees and is only  a couple of months from debuting live. [Engadget]

NEW XBOX 360 CONTROLLER NO LONGER A RUMOR

The rumored new Microsoft Xbox 360 controller has made an appearance.  Major Nelson has a video up of the controller and we have a picture.  As reported the D-pad turns into a four way directional pad with a twist and more comfortable grips. Oh, and it's silver.

That's the good news...the bad news is it will only be part of a $65 bundle that comes out November 9th. [Major Nelson]

RUMOR: NEW XBOX CONTROLLER COMING

There is a new rumor hitting the game sites that Microsoft will be releasing a new and improved Xbox 360 game controller.  Specifically, the D-pad when rotated ninety degrees will raise up about a quarter of an inch.  This is apparently targeted towards fighting game fans.

There are a lot of questions still to be answered and Microsoft is remaining mum about the whole thing. [Joystiq]
